However, you agree that Free Market Foundation has the right to monitor the Free Market Foundation Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Free Market Foundation Site properly, or to protect itself or its subscribers. Free Market Foundation reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.

3. Privacy

Free Market Foundation cannot ensure or guarantee privacy for Free Market Foundation users. It is therefore recommended that this service not be used for the transmission of confidential information. Any such use shall be at the sole risk of the user, and Free Market Foundation and its affiliates, suppliers and related companies shall be relieved of all liability in connection therewith.

4. Buying over the Internet

When making purchases or conducting other transactions through the Free Market Foundation Site or the Internet, you may be asked by the Merchant or Information or Service Provider, to supply certain information, including credit card or other payment mechanisms. You agree that all information you provide any merchant or Information or Service Provider through the Free Market Foundation Site will be accurate and complete. You agree to pay all charges incurred by you or other users of your account or credit card or other payment mechanisms at the prices in effect when such charges are incurred. You also will be responsible for paying all applicable taxes, if any, relating to purchases on the Free Market Foundation Site. Free Market Foundation is in no way responsible for any charges you or any user of your account incurs when making purchases or other transactions in this manner.

  • Detailed description of goods and/or services

    The Free Market Foundation is a Public Benefit and Non-Profit Organisation that promotes and fosters an open society, the rule of law, personal liberty, and economic and press freedom as fundamental components of its advocacy of human rights and democracy based on classical liberal principlesis. It receives membership subscriptions, donations and grants and markets publications.

  • Delivery policy

    Subject to availability and receipt of payment, requests will be processed within 7 days and delivery confirmed by way of an email quoting a postal or courier tracking number. Where postal or courier charges are not included in quoted prices the postal or courier charges required to be added when making payment, if applicable, will be clearly stipulated.

  • Export restriction

    The offering on this website is available to South African clients only

  • Return and Refunds policy

    The provision of goods and services by the Free Market Foundation is subject to availability. In cases of unavailability, the Free Market Foundation will refund the client in full within 30 days. Cancellation of orders by the client will attract a no administration fee. Books damaged in transit will be replaced free of charge.

  • Customer privacy policy

    The Free Market Foundation shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

  • Payment options accepted

    Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into The Free Market Foundation bank account, the details of which will be provided on request.

  • Credit card acquiring and security

    Credit card transactions will be acquired for The Free Market Foundation via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

  • Customer details separate from card details

    Customer details will be stored by The Free Market Foundation separately from card details which are entered by the client on PayGate's secure site. For more detail on PayGate refer to www.paygate.co.za

  • Merchant Outlet country and transaction currency

    The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

  • Responsibility

    The Free Market Foundation takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods

  • Country of domicile

    This website is governed by the laws of South Africa and The Free Market Foundation chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Floor 0, Prime Meridian House, Building 6, Bryanston Gate, 170 Curzon Road, Bryanston, 2021

  • Variation

    The Free Market Foundation may, in its sole discretion, change this agreement or any part thereof at any time without notice.

  • Company information

    This website is run by a Public Benefit and Non Profit voluntary association based in South Africa trading as the Free Market Foundation and with registration number 020-056-NPO.

5. Limitation of Liability

The Free Market Foundation takes no responsibility for the accuracy or validity of any claims or statements contained in the documents and related graphics on the Free Market Foundation Site. Further, Free Market Foundation makes no representations about the suitability of any of the information contained in documents and related graphics on the Free Market Foundation Site for any purpose. All such documents and related graphics are provided without warranty of any kind. In no event shall Free Market Foundation or its suppliers or affiliates be liable for any damages whatsoever, including special, indirect or consequential damages, arising out of or in connection with the use or performance of information available from the service.

6. Recourse

If you are dissatisfied with the Free Market Foundation Site or with any terms, conditions, rules, policies, guidelines, or practices of Free Market Foundation in operating the Free Market Foundation Site, your sole and exclusive remedy is to discontinue using the Free Market Foundation Site.

7. Confidential Information

You authorise Free Market Foundation to collect from any party and to retain all relevant information relating to your use of the Free Market Foundation Site, and you hereby authorise any party to provide us with such information.

8. Indemnity

You agree to defend, indemnify and hold Free Market Foundation and its affiliates, suppliers and related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of this Agreement by you or users of your account, or in connection with the use of the Free Market Foundation Site or the Internet or the placement or transmission of any message, information, software or other materials on the Free Market Foundation Site or on the Internet by you or users of your account.

9. Trademarks

Free Market Foundation and other trade marks, logos and icons identifying Free Market Foundation and Free Market Foundation products and services referenced herein are trademarks or registered trademarks of Free Market Foundation. All other product and/or brand or company names mentioned herein are the trademarks of their respective owners.

10. Miscellaneous

This Agreement, including any and all documents referenced herein, constitute the entire agreement between Free Market Foundation and the user pertaining to the subject matter hereof. Free Market Foundation's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provisions or right. If any of the provisions contained in this Agreement were determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions contained herein. This Agreement shall be governed by and construed in accordance with the prevailing laws of South Africa.
